Terms of Use

Micava (the “Service”) is provided by its operator, Jorge Maya (“Micava”, “we”, “us”). These Terms govern your use of the Service, including the website, the app and any related features.

By creating an account or continuing to use Micava, you accept these Terms. If you do not agree, do not use the Service.

You must be of legal age to enter into a contract in your country. You agree to provide accurate account information, keep it up to date, and keep your sign-in credentials confidential. You are responsible for activity carried out under your account.

Anyone may create a Micava account. Access to the Service may be modified, limited, suspended or discontinued at any time, and features may change as the product evolves.

Members may invite other people to join Micava, but we retain final control over who may access the Service and may suspend or revoke access to any account, including accounts created through an invitation, for example in cases of abuse, fraud or breach of these terms.

Micava may be offered as a paid subscription. Subscriptions renew automatically for successive billing periods until they are cancelled.

Micava may also include a complimentary introductory period and promotional credits, such as credits earned for inviting other members. The length of any introductory period, the value and number of credits, eligibility rules, and any maximum that can be earned or applied form part of a promotional program that we may change, limit, suspend or end at any time.

The current terms of the program are those shown inside the app at the time you use it. Credits and complimentary periods are personal, have no cash value and cannot be sold, transferred or exchanged.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Billing, taxes, invoices, payment methods, cancellations and refunds are handled by Paddle under the Paddle Checkout Buyer Terms. See our Refund Policy and our pricing page for current plans.

You agree not to:

• Use Micava for unlawful, fraudulent or abusive purposes, or to send spam.
• Infringe the intellectual property or privacy rights of others.
• Interfere with the security or integrity of the Service, including malware, probing, scanning or unauthorized access attempts.
• Scrape, harvest or bulk-extract data from the Service.
• Circumvent technical limits, reverse engineer the Service, or resell or redistribute it.
• Abuse the invitation or credit program, including by creating duplicate, automated or fake accounts.

Micava uses artificial intelligence and third-party data sources for features such as label recognition, wine metadata, images and suggestions.

Results may be inaccurate, incomplete or unavailable and are not authoritative. You are responsible for reviewing and correcting the information stored in your cellar, and for holding the necessary rights to any image you upload.

If you believe content in Micava infringes your rights, write to support@winequest.ai and we will review and, where appropriate, remove it. We may restrict or suspend accounts for repeated infringement.

You keep ownership of the wines, bottles, photos, ratings and notes you add to Micava. You grant us a limited licence to host, store and process that content solely to operate and provide the Service to you and to the cellars you share.

Micava, including its software, design, branding and underlying technology, belongs to its operator or its licensors. All rights are reserved.

Micava is provided “as is” and “as available”. We do not guarantee that the Service will be uninterrupted, error-free, secure against every risk, or that data will be preserved indefinitely.

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid for Micava in the twelve months before the event giving rise to the claim.

We are not liable for indirect, incidental, special or consequential damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury, or any liability that cannot be excluded by law.

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may stop using Micava at any time and cancel your subscription.

When access ends, we will provide a reasonable period to export your data on request, after which your content may be deleted, subject to backup and legal retention requirements.

We may update these Terms as Micava evolves. Continued use after an update constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Colombia.
